These Terms of Service apply to this website, online store, quote tools, products, digital products, physical products, custom requests, and services offered through Heartland FabCo.

Heartland FabCo is operated by Heartland Variety LLC, an Indiana limited liability company. References to “Heartland FabCo,” “FabCo,” “we,” “us,” or “our” mean Heartland Variety LLC operating through the Heartland FabCo brand.

Heartland FabCo is powered by Shopify, which enables us to provide this website, store, checkout, customer account features, and related ecommerce services.

By visiting, browsing, interacting with, submitting information through, placing an order through, or using this website, you agree to these Terms of Service and our Privacy Policy. We may limit quantities, refuse orders, discontinue products, change product offerings, or restrict availability by person, order, geographic region, jurisdiction, or capability on a case-by-case basis.

5. Product Information and Website Accuracy

We make reasonable efforts to describe products, services, materials, processes, options, colors, dimensions, specifications, images, and pricing accurately. However, we do not guarantee that all website content, product descriptions, images, renderings, prices, lead times, shipping estimates, availability, or specifications are complete, current, or error-free.

Colors, finishes, material appearances, scale, texture, and product appearance may vary due to screen settings, photography, lighting, manufacturing variation, supplier variation, finishing methods, or normal production tolerances.

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. We may update information, change pricing, cancel orders, issue refunds, or request clarification if information on the website, in a quote tool, or in checkout is inaccurate.

6. Orders

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance, receive payment, and approve the order for processing.

We may accept, decline, cancel, hold, or modify an order for any reason, including but not limited to product availability, pricing errors, shipping issues, payment issues, suspected fraud, technical errors, file issues, manufacturability concerns, safety concerns, or requests outside our capabilities.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order has been accepted, produced, downloaded, customized, shipped, or otherwise fulfilled.

If we change, decline, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, phone number, or account information provided at the time of order.

7. Pricing, Billing, and Payment

Prices are listed in U.S. dollars unless otherwise stated. Prices, discounts, promotions, shipping charges, and product availability are subject to change without notice.

The price charged for a product or service will generally be the price shown at the time the order is placed, unless that price is affected by a technical, pricing, configuration, tax, shipping, or data error.

Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs, import charges, duties, or other fees.

You agree to provide current, complete, and accurate purchase, payment, billing, and account information. You represent that you are authorized to use the payment method you provide and that charges incurred by you will be honored by your payment provider.

Payment is due at checkout or as otherwise agreed in writing. Orders are not accepted for production, download, shipment, or fulfillment until payment is received and the order is approved for processing.

Applicable sales tax or other taxes may be calculated and collected at checkout based on the order, shipping destination, tax settings, and applicable law.

You are responsible for any taxes, duties, fees, or charges that are not collected at checkout but are legally owed.

9. Automated Quotes and Custom Quote Requests

Automated quotes are based on the information, files, quantities, materials, and settings provided at the time of quote. A displayed quote does not guarantee that a project can be produced exactly as submitted.

We may review, adjust, reject, cancel, or refund a quote or order if we determine that:

  • The file is incomplete, corrupted, inaccurate, unsafe, or not manufacturable
  • The selected material or process is not appropriate for the design
  • The quoted price was affected by a technical, pricing, configuration, or data error
  • The project requires clarification, redesign, engineering review, or manual handling
  • The request is outside our current equipment, material, safety, shipping, or workflow capabilities
  • The request violates these Terms or any applicable law

Custom quote requests are reviewed case by case. Submitting a custom quote request does not obligate us to accept the project, provide a quote, meet a timeline, or produce the requested item.

10. Customer-Supplied Files and Information

You are responsible for the accuracy, completeness, legality, and suitability of all files, drawings, dimensions, specifications, notes, reference images, links, instructions, and other information you submit.

By submitting files or project information, you represent that you have the right to use and provide those materials and that our use of them to review, quote, manufacture, communicate about, or fulfill your request will not violate any third-party rights.

We are not responsible for defects, fitment issues, performance problems, production errors, delays, or rejected work caused by inaccurate, incomplete, incompatible, unlawful, infringing, or unsuitable customer-supplied files or instructions.

11. Intellectual Property

This website, our branding, logos, designs, product names, service names, slogans, photos, graphics, text, product descriptions, digital products, templates, files, layouts, tools, workflows, and other content are owned by Heartland FabCo, Heartland Variety LLC, our licensors, or other applicable rights holders and are protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, scrape, resell, or exploit our website content, product content, digital products, files, templates, or other intellectual property without our prior written permission, except as expressly allowed by a product license or these Terms.

You retain ownership of files and designs you submit, subject to the rights you grant us to review, quote, manufacture, communicate about, and fulfill your request.

Unless otherwise agreed in writing, purchasing a product or service from Heartland FabCo does not transfer ownership of our designs, files, templates, tooling, workflows, product concepts, website content, branding, photos, graphics, or other intellectual property.

12. Digital Products

Digital products may include downloadable files, templates, plans, designs, instructions, layouts, or other electronic resources.

Unless a product listing states otherwise, digital products are licensed, not sold. They are for personal or internal business use by the purchaser only.

You may not resell, redistribute, publish, share, sublicense, upload to file-sharing sites, include in another product or service, or otherwise commercially exploit our digital products without written permission.

Because digital products can be accessed or downloaded immediately, all digital product sales are final unless required by law or unless we determine that a refund is appropriate due to a technical issue, duplicate purchase, or other exceptional circumstance.

13. Physical Products

Product images, descriptions, dimensions, colors, materials, and specifications are provided for general reference. Actual products may vary slightly due to manufacturing processes, material variation, finishing methods, supplier changes, lighting, photography, screen settings, or normal production tolerances.

Some products may be made to order, produced in small batches, customized, or fulfilled after purchase. Lead times shown on product pages or during checkout are estimates unless explicitly stated otherwise.

14. Fabrication Tolerances and Fit

3D printed, CNC-machined, laser-cut, engraved, and fabricated parts may have normal process variation. Tolerances depend on the material, machine process, design geometry, finishing method, customer-supplied file quality, and project-specific requirements.

Unless we expressly agree in writing to a specific tolerance, certification, testing standard, or engineering requirement, products and fabricated parts are provided as practical commercial goods, not certified aerospace, medical, life-safety, structural, or regulated-use components.

You are responsible for determining whether a product, file, part, material, design, or service is suitable for your intended use.

15. Prohibited or Restricted Work

We may reject or cancel any request involving items we consider unsafe, unlawful, infringing, deceptive, regulated, or outside our comfort level or capabilities.

This may include, without limitation, requests involving weapons, weapon components, illegal items, counterfeit goods, infringing trademarks or copyrighted works, regulated safety-critical parts, medical devices, life-safety components, or components intended for use in hazardous applications.

We may also reject requests that require professional engineering, code certification, regulated product approval, specialized testing, or safety validation that we have not expressly agreed to provide in writing.

16. Shipping and Delivery

Shipping costs, available shipping methods, and estimated delivery timelines may vary by product, destination, weight, package size, and carrier availability.

Shipping timelines are estimates only and are not guaranteed unless expressly stated. We are not responsible for carrier delays, weather delays, customs delays, incorrect shipping addresses, delivery interruptions, theft after delivery, or events outside our control.

Subject to applicable law, title and risk of loss generally pass to you when products are transferred to the shipping carrier or otherwise marked delivered by the carrier.

You are responsible for providing a complete and accurate shipping address. Additional charges may apply for address corrections, reshipments, returned packages, or failed delivery attempts.

17. Returns, Refunds, and Cancellations

Returns, refunds, and cancellations are governed by our Refund Policy and any product-specific terms shown on the product page.

Made-to-order items, custom fabricated items, personalized items, customer-file-based work, digital products, and downloaded files may be non-returnable or non-refundable unless required by law or unless we determine that an exception is appropriate.

18. Confidentiality and Project Information

We treat customer project information as sensitive whether or not a formal nondisclosure agreement is in place.

However, submitting information through this website, email, quote tools, forms, file links, or third-party services is not the same as entering into a formal NDA. A formal NDA must be separately reviewed and signed by Heartland Variety LLC before it becomes binding.

Do not submit highly confidential, export-controlled, regulated, classified, or legally restricted information unless we have expressly agreed in writing to receive and handle that information.

19. Feedback, Reviews, and Suggestions

If you submit ideas, suggestions, reviews, feedback, improvements, product requests, comments, photos, testimonials, proposals, or other similar content, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use that content for business, operational, promotional, and service-improvement purposes.

You represent that you own or have the necessary rights to provide the content, that the content is accurate to the best of your knowledge, and that it does not violate the rights of any third party.

We are not obligated to keep feedback confidential, pay compensation for feedback, respond to feedback, or use feedback.

Heartland FabCo is powered by Shopify, which enables us to provide this website, store, checkout, and related ecommerce services.

However, sales and purchases made through this store are made directly with Heartland FabCo. By using this website or purchasing from us, you acknowledge that Shopify is not responsible for any aspect of sales between you and Heartland FabCo, including any injury, damage, loss, product issue, service issue, fulfillment issue, or dispute resulting from products or services purchased from Heartland FabCo.

You release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases, transactions, or relationship with Heartland FabCo.
